TERMS OF SERVICES

These Terms of Service (“Terms”) govern your use of the website www.coverartworkdesign.com and any related services (collectively, the “Services”) provided by CoverArtworkDesign (“we,” “us,” or “our”). By accessing or using our site and Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Services

1.1 Scope.

We offer custom visual design services, including—but not limited to—album covers, product imaging, merchandise mockups, social media graphics, and YouTube thumbnails.

1.2 Order Process.

All projects begin with your completion of the Project Inquiry Form or direct consultation. We’ll respond with a written proposal including scope, timeline, deliverables, and pricing.

2. Client Responsibilities

Accurate Information. You agree to provide clear, complete, and accurate project requirements, reference materials, and feedback.

Timely Feedback. Prompt review and approval at each stage are essential to keep the project on schedule.

Intellectual Property. You warrant that any materials you supply (images, logos, text) do not infringe third‑party rights and grant us a license to use them for your project.

3. Pricing & Payment

3.1 Fees.

All fees are outlined in your customized proposal. A 50 % deposit is required to secure your project slot; the balance is due on final delivery.

3.2 Invoicing.

Invoices are issued as PDF documents via email. Payment is due within 7 days (“Net 7”) of invoice date unless otherwise agreed in writing.

3.3 Late Payments.

Overdue invoices may incur a late fee of 1.5 % per month on the outstanding balance.

4. Revisions & Approval

Each project includes up to two rounds of revisions as specified in your proposal.

Additional revisions are billed at our standard hourly rate, which will be disclosed in advance.

Final approval—provided in writing—is required before delivery of source files and project hand‑off.

5. Ownership & License

Deliverables. Upon full payment, you receive a non‑exclusive, perpetual license to use final deliverables for the agreed‑upon purposes (streaming, print, merchandise, etc.).

Source Files. Any working files (PSD, AI) remain our property unless explicitly licensed in your proposal. Additional license fees may apply for transfer of source files.

Third‑Party Assets. Fonts, stock images, or plugins licensed separately by us may be subject to their own terms and may require an additional license for your use.

6. Confidentiality

We treat all project details as confidential. We will not disclose your proprietary information or unpublished materials to any third party without your written consent, except as required by law.

7. Limitation of Liability

To the maximum extent permitted by law, CoverArtworkDesign’s total liability for any claim arising out of or relating to these Terms or the Services will not exceed the total fees you have paid for the specific project at issue. We are not liable for any indirect, incidental, or consequential damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless CoverArtworkDesign and its affiliates against any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Services.

9. Termination

Either party may terminate a project by written notice if the other party materially breaches these Terms and fails to cure within 10 days. Upon termination, you will pay for all work completed up to the date of termination.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of [Your State/Country], without regard to conflict‑of‑law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in [Your City], and you consent to their exclusive jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. The “Last updated” date at the top will reflect changes. Continued use of our Services after updates constitutes acceptance of the revised Terms.
